Legal Malpractice - Examples

In one recent legal malpractice case, our client sought to sue his attorney for failing to meet a filing deadline for a labor law claim. This seemingly straightforward case took a more interesting turn, however, when our investigation uncovered the fact that the attorney in question was in fact an out-of-state lawyer who was attempting to practice law in California against the rules of the courts and the State Bar. We discovered through extensive background research that the attorney in question had been repeatedly disciplined for these activities, as had other members of his (allegedly "nationwide") law firm.

In another recent legal malpractice case in which the person who committed legal malpractice had missed a statute of limitation filing deadline for a personal injury auto accident case, our investigation revealed that the person the clients assumed was their attorney had never been admitted to the practice of law – he was a non-lawyer trying to pass himself off as their attorney. As a result, the clients expanded their lawsuit to encompass the law firms who aided and abetted in his unlawful practice of law without a license.

Another legal malpractice case in which the attorney missed a statute date once again involved an employee practicing law without a license – in this case, a disbarred local attorney who had been employed by the law firm. Our client prevailed in two separate legal malpractice suits regarding this incident, one against the firm and one against the disbarred attorney as an individual.

A missed bankruptcy filing deadline was the basis for yet another of our legal malpractice cases. The legal malpractice of the bankruptcy attorney in that case resulted in our client losing his home. Fortunately he recovered his losses in the settlement with the attorney who committed the legal malpractice.
