WRONGFUL DEATH – MEDICAL MALPRACTICE

In one of our medical malpractice wrongful death claims, the decedent suffered a punctured artery during a cardiac angiography when the doctor accidentally poked a catheter through the patient's pulmonary artery. The puncture resulted in the patient bleeding to death on the operating table over a period of approximately eleven hours. While puncturing an artery is considered a normal risk of the angiography, the doctor was negligent in failing to take steps to recognize and control the patient's bleeding before it harmed (and ultimately killed) the patient. In another medical malpractice wrongful death claim we represented the mother of a disabled patient of 38 who was confined to a wheelchair and required round-the-clock breathing assistance and monitoring of their breathing and other vitals. The case arose when the patient's ventilator breathing tube came loose while the home care nurse was outside taking a cigarette break with his other attendant. Due to their location, they failed to hear the warning alarm and returned only some time later to find their patient asphyxiating on the floor. Despite the efforts of paramedics, he died soon after arriving at the hospital. The nurse and attendant initially denied they had left the patient's immediate vicinity and attempted to blame his suffocation on either a malfunctioning ventilator unit or his deteriorating condition.
